Fnac Darty Faces €7 Million Fine for Unlawful Mobile Tracking

The French data protection authority imposed a €7 million penalty on electronics retailer Fnac Darty for deploying third‑party trackers in its mobile application without obtaining user consent. The sanction followed a 2023 complaint by the privacy advocacy group noyb, which highlighted the company’s unauthorized collection and sharing of personal data for targeted advertising.

CNIL’s investigation confirmed that the trackers were activated immediately upon app launch, enabling detailed profiling of users across France and other markets where Fnac Darty operates, including Spain, Italy, Portugal, Belgium, and Switzerland. The decision underscores the regulatory stance against covert data collection and reinforces the need for transparent consent mechanisms in mobile apps.
