The completely revised Data Protection Act (DSG) and the implementing provisions in the new Data Protection Ordinance (DSV) and the new Ordinance on Data Protection Certifications (VDSZ) will come into force on September 1, 2023. The Federal Council decided this at its meeting on August 31, 2022. This gives the economy enough time to take the necessary precautions for the implementation of the new data protection law.
The completely revised DSG and the corresponding provisions in the ordinances will ensure better protection of personal data in the future. In particular, data protection is adapted to technological developments, self-determination over personal data is strengthened and transparency in the procurement of personal data is increased.
In order to take account of the results of the consultation on the implementation provisions, the Federal Council has amended the draft of the DSV in several points. For example, he has thoroughly revised the chapter on the duties of those responsible and, in particular, freed private individuals from certain information duties when disclosing personal data. The modalities of the right to information have also been simplified and the obligation to provide documentation has been eliminated. In the area of ​​data security, the Federal Council has partially adjusted its original proposal due to the critical feedback in the consultation. For example, the retention period for data processing logs has been set at at least one year. In addition, a new provision was added
Important implementation deadline
With the entry into force of the new data protection law and the ordinances on September 1, 2023, the Federal Council is responding to a request from the economy. The implementation period of one year gives those responsible for data protection enough time to take the necessary precautions to implement the new data protection law.
New data protection law strengthens the business location
Parliament passed the total revision of the Data Protection Act on September 25, 2020. The new data protection law ensures compatibility with European law and makes it possible to ratify the modernized data protection convention 108 of the Council of Europe. These adjustments to the new data protection law are important so that the EU will continue to recognize Switzerland as a third country with an appropriate level of data protection and cross-border data transmission will remain possible in the future without additional requirements. This is central to Switzerland as a business location and competitiveness. The EU has recognized the level of data protection in Switzerland since the year 2000. This recognition is currently being reviewed.
