  • Definition Expansion: Introducing a broad definition of “reproductive health care” to encompass services related to an individual’s reproductive system, including contraceptives, pregnancy-related care, fertility treatments, and more.

  • Prohibited Uses and Disclosures: Restricting the use or disclosure of PHI for investigations or proceedings against individuals or providers concerning lawful reproductive health care services, particularly when such services are provided across state lines or are protected by federal law.

These proposed changes aim to strengthen privacy protections for individuals seeking reproductive health care, ensuring that their health information is not used against them in legal or administrative actions.
