Digital Fairness Act: EU Tackles Dark Patterns

UK Version of GDPR

The European Commission’s Digital Fairness Act initiative, currently in public consultation, is set to tackle “dark patterns”—manipulative design tactics that nudge users into decisions they wouldn’t otherwise make (e.g., hidden opt-outs, misleading buttons). The Act aims to strengthen consumer protection and transparency rules for online services and marketplaces, with new requirements expected for contract presentation and influencer marketing disclosures. This consultation phase in 2025 will inform the final proposal, expected in 2026. Businesses should begin reviewing their UX and consent flows to ensure they don’t use tactics likely to be outlawed.
