ANPD Opens Public Consultation on the Standard for Reporting Security Incidents with Personal Data (3/2/2023)

UK Version of GDPR

The National Data Protection Authority (ANPD) published this Tuesday, May 2, 2023, the Public Consultation on the draft resolution regarding the Regulation for Reporting Security Incidents with Personal Data, in compliance with article 48 and paragraphs of the LGPD.

The Consultation will be available on the Participa Mais Brasil platform between May 2nd and 31st.

Information about the public hearing will be released soon, which will take place in a virtual format and will be broadcast on the ANPD YouTube channel.

Standard

The purpose of the draft Resolution is to regulate the forecast of communication, by the controller, about the occurrence of security incidents that may cause risk or relevant damage to the holders of personal data, under the terms of Article 48 of the LGPD.

The proposal for regulation also provides for the specification of the deadline for notifying the Authority, under the provisions of paragraph 1 of the same article.

Public Consultation

The public consultation will be available on the Platform for the next 30 days and will end on May 31, 2023. This is the only accepted mechanism for sending contributions to the ANPD, respecting the established deadline.

Through the Platform, everyone can collaborate with the elaboration of public policies and with the bodies’ decision-making processes, using the various means of social participation available, and all contributions made are available for consultation, upon login.

In it, the Regulatory Impact Analysis Report and the vote cast by the Reporting Director on the matter were also made available.
