The National Data Protection Authority (ANPD) published this Monday, August 30, 2021, the Public Consultation on the draft resolution that regulates the application of Law No. of Personal Data Protection (LGPD), for micro and small companies, as well as for business initiatives of an incremental or disruptive nature that declare themselves startups or innovation companies, under the terms of art. 55-J, item XVIII of the law.
The consultation will be available on the Participa + Brasil platform for the next 30 days.
The public hearing was scheduled for September 14 and 15, 2021.
The norm
The standard proposed by the ANPD seeks to facilitate the adaptation to the LGPD by micro and small companies, as well as for business initiatives of an incremental or disruptive nature that declare themselves to be startups or innovation companies and other entities included in the draft, which named this group as agents small treatment.
The draft resolution presents the possibility of adopting simplified and differentiated procedures, facilitating this group’s compliance with the LGPD and contributing to the dissemination of the culture of personal data protection.
According to Arthur Sabbat, who reported the case, this regulatory alternative aims to guarantee the rights of data subjects, while bringing a balance between the rules contained in the LGPD and the size of the data processing agent.

Public Consultation
The public consultation is available on the Participa mais Brasil platform for the next 30 days and will end on September 29, 2021. The platform is the only accepted mechanism for sending contributions to the ANPD.
Through the platform, everyone can collaborate with the elaboration of public policies and with the bodies’ decision-making processes, using the various means of social participation available on the platform, and all contributions made are available for consultation.
The Regulatory Impact Analysis Report and the votes cast by directors were also made available on the platform.
In addition, the ANPD provided a presentation with explanations on participation in the platform.
It is informed that contributions must be sent exclusively through the platform, respecting the established deadline. Contributions sent by other means will not be considered.
Public Hearing
The public hearing will be held on September 14 and 15, 2021, according to the Order published on August 30, 2021.
Those interested in making oral statements during the hearing must register in advance by 6 pm on 09/09/2021.
The session will be open to the public and, during the session, previously registered interested parties will be able to comment on the draft resolution.
The public hearing will be broadcast on the ANPD YouTube channel and registration is not required for those who just want to watch.
